1.0 General Provisions

This website is maintained by Next Door Driving, Inc (hereinafter, referred to as “Next Door Driving, INC” and “NextDoorDriving.com", “us” “our” or “we”) for the purpose of providing online courses, training and services dependent upon the approvals and certifications of the state and their governing agencies.

Please read our terms and conditions carefully. By using our website and services you have accepted these terms and conditions. If you do not agree to the terms, do not use our website or services.

Please note, these terms contain a class action waiver of a right to a jury trial, and a mandatory arbitration clause.

This Terms of Use Agreement is in other words a contract between the registered user and Next Door Driving, Inc DBA NextDoorDriving.com. This is a legal agreement between the registered user (“student, enrollee”) and Next Door Driving, Inc DBA NextDoorDriving.com. By registering for the course and making payment, registering and using this website, the enrolled user, student, individual agrees to follow the terms of this agreement.

NextDoorDriving.com may make changes to any relevant terms and conditions, policies or notices at any time. By reading these terms you acknowledge that by visiting the website, you agree to the current version of the applicable terms and conditions. By this, you also agree to any updates in versions that may apply. All previous versions shall be superseded by the updated version. You are responsible for reviewing the then current/updated version each time you visit the website.

Next Door Driving, INC DBA NextDoorDriving.com offers drivers education courses. The course will be available to the registered user 24 hours a day, 7 days a week. This availability may be affected by circumstances such as, but not limited to: system, site or connectivity failure over which NextDoorDriving.com has no control.

2.0 Hardware and Software Requirements

NextDoorDriving.com requires the registered user to meet minimum hardware and software requirements for taking and completing the course. Minimum browser requirements are the use of Microsoft Internet Explorer (versions 11.0 or greater), Firefox, Google Chrome, or any other browsers that provide equal or greater functionality. We recommend that whichever device you choose to use is equipped with speakers, as courses may contain audio visual materials.

3.0 Completion and Certification Policy

The registered user must agree to complete all modules of the curriculum to receive a certificate of completion. The registered user may be required to pay fees to NextDoorDriving.com, if the registered user requests a duplicate and/or reissue of the original certificate of completion.

4.0 Course Completion

The registered user will have 2 years from their start date to successfully complete the course.

5.0 Circumvention Disclosure

The registered user/student agrees that he/she, and not any other person, will study the material in its entirety and complete the module, quizzes and the final exam. It is illegal to attempt to bypass this course or provide false information. If NextDoorDriving.com discovers that the registered user/student has willfully misrepresented himself/herself or has cheated, the registered user will be stopped from taking the course with no refund of the registration fees. In addition, the registered user/student may be prosecuted for perjury and other criminal acts which are punishable by law.

6.0 Privacy Statement

NextDoorDriving.com collects information and data from its users at several different points on the website. NextDoorDriving.com will not use or sell this information to promote products or services unrelated to this course/product or in ways different from what is disclosed in the Privacy Policy. By agreeing to these terms and conditions, you are agreeing to the collection, use and disclosure of your personal information as described in the Privacy Policy. 7.0 Changes in our Privacy Policy

As stated in this Privacy Policy, we are the data controller and data processor, we reserve the right to change or modify this Privacy Policy at any time. If changes need to be made and/or submitted, information will be found in this Privacy Policy section. We will also ensure to notify you via email that certain changes have been made.

8.0 Announcements and Notices

Announcements and notices to the registered user/student may be made via either email, regular mail or by displaying notices or links to notices on NextDoorDriving.com website.

9.0 Confidentiality

You must agree to keep your password confidential and the registered user (student) is responsible for the use of your account and password. We reserve the right to remove, reclaim or change the username you select if we determine. NextDoorDriving.com does not keep password information regarding the registered user (student) in an open form. NextDoorDriving.com keeps the registered users' (students') information confidential and will not share your information via phone or email without proper verification requirements being met.

10.0 Children’s Privacy

NextDoorDriving.com websites, services, are not intended to be used by children under 13 years old. No one under age 13 years old can provide personal information to our support services or on our websites. We do not collect information from children under 13 years old. If you are under 13 years old, you’re not allowed to use any of our websites, buy products available on NextDoorDriving.com, comment on posts, make social media posts or provide any personal information about yourself including your name, address, phone number, email. If we discover that you violated this term. We will delete your account, as well as all information you inputted. 11.0 Refund Policy

It is of great importance that you are satisfied with your purchase. If you change your mind about the course, we will refund the full cost of any course purchased on our website within thirty (30) days of purchase, as long as a certificate of completion, certificate of partial completion, or letter of transfer has not been issued. Once a certificate of completion, partial completion certificate or letter of transfer has been issued, no refund will be available. Refunds will only be issued if the course has not been completed. We will issue your refund within thirty (30) days of your request.

12.0 Data

This data protection declaration is to inform the general public of the reasoning, essence, and purpose of the personal data we collect, use, and process. As you are now informed of this data declaration and the rights in which you are entitled to. Next Door Driving, Inc is the data controller and processor. We have implemented numerous technical and security measures to ensure complete protection of your personal data through our website. Since Internet-based data transmissions may have security gaps, absolute protection cannot be guaranteed. Any consumer who prefers to avoid using our internet-based site, may always choose to transfer personal data information in person, by the use of email or phone support.

13.0 Cookies Disclosure

We use cookies to improve the user experience, as well as, our website requires them to function properly for the services you have registered for. If you disable your cookies, you may not be able to view and access all features on our website.

14.0 License Restrictions

This license restriction clause states that the registered user (student) will not copy any content of NextDoorDriving.com. Registered users (students) may not modify, translate, adapt, or make improvements to the course. Registered users (students) may not reverse engineer, disassemble, decompile, decode or otherwise attempt to derive or gain access to the source code in any part of the online course using different hardware devices. Registered users (students) may not delete, remove, change or manipulate any trademarks or any copyright, patent or other intellectual property or proprietary rights notice from the online course. Registered users (students) must not lend, sell, assign, distribute, publish, exchange or otherwise make available the online course or to any third party for any reason, including making the course available on a network where it is available to be used by more than one device at any time. If for some reason these restrictions are prohibited by applicable law or by an agreed upon contract we have with one of our licensors, then the activities are permitted only to the extent necessary to comply with such law or license(s).

15.0 Reservation of Rights

The registered user (student) acknowledges that the course is licensed. The course is not being sold to any particular registered user or student. NextDoorDriving.com reserves all rights in and to the course not expressly granted to you under this contract. You do not acquire any ownership interest in the course under this contract. NextDoorDriving.com and its licensors reserve and retain the entire right title and interest in the course, including all copyrights, trademarks, and other intellectual property rights shown. If you submit comments, suggestions, surveys or other feedback regarding the site (“Surveys” or “Feedback”). NextDoorDriving.com will be allowed to use such information for any purpose.

16.0 Class Action Waiver Disclosure

For any dispute between registered user (student) and NextDoorDriving, Inc, or any other user, student and NextDoorDriving, Inc must agree that each can only bring a claim against each other on an individual basis. Neither registered user (student) nor NextDoorDriving, Inc can bring a claim as a plaintiff or class member in a class action, consolidated action, or representative action. If a court decides that this “Class Action Waiver” section is not enforceable or is invalid, then this section shall cease to have effect, however, the remaining portions of the contract will remain in full force and effect.

17.0 Waiver of Right to Jury Trial

Registered user (student) knowingly, voluntarily, intelligently, and irrevocably waives his or her rights to a jury trial of any claim or cause of action based upon, arising out of, or in any manner relating to this contract and/or NextDoorDriving, Inc’s performance or failure to perform. The scope of this waiver is intended to be all-encompassing and shall apply to any and all claims arising under federal law or any states' laws and that arise from or relate in any way to the subject matter of the contract and/or NextDoorDriving, Inc’s performance, including, without limitation, contract, tort, and all other statutory or common law claims seeking equitable or legal relief, whether asserted as a cause of action, counterclaim, cross-claim, affirmative defense, or otherwise, and whether asserted on an individual basis or as putative representative of a class. Registered user (student) expressly acknowledges that this provision is an essential aspect of the bargain embodied by the contact. If a court decides that this “Waiver of Right to Jury Trial” section is not enforceable or is invalid, then this section shall cease to have effect, however, the remaining portions of the contract will remain in full force and effect.

18.0 Claims Subject to Mandatory and Binding Arbitration

This is subject to and without limiting the Governing Law and Forum Selection section, the registered user (student) expressly agrees that any claim or cause of action that arises from, relates to, or has connection with the Mobile App and/or Online course must be adjudicated exclusively and finally by arbitration in Sacramento, CA administered by the American Arbitration Association. The arbitration award must be final and binding, and judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction. Except as required by applicable law, the registered user (student) must knowingly, voluntarily, intelligently, and irrevocably waives any right to appeal from the arbitration award, including but not limited to any appeal from any judgment entered on the arbitration award or any order based thereupon. The registered user (student) must agree that any claim or cause of action that is subjection to arbitration under this agreement must be brought in his or her individual capacity and not as a plaintiff or class member in any purported class or representative proceeding. The registered user (student) must agree that the arbitrator shall not consolidate more than one person’s claims and may not otherwise preside over any form of a representative or class proceeding. If a court decides this “Mandatory and Binding Arbitration” section is not enforceable or is invalid, then this section shall cease to have effect, however, the remaining portions of the agreement will remain in full force and effect.

19.0 Attorney Fee Clause

If Next Door Driving, Inc takes action (by itself or through its representatives) to enforce any of the provisions of this agreement, including collection of any amounts due, in addition to all sums to which it is entitled or any other relief, at law or in equity, Next Door Driving, Inc shall be entitled to recover from registered user (student) and registered user (student) must agree to pay, reasonable and necessary attorney’s fees and all costs of any litigation or other dispute resolution proceeding.
